1. About these Terms#
1.1 These Terms & Conditions ("Terms") govern your access to and use of the RapidMedico website https://rapidmedico.com and the RapidMedico mobile applications (together, the "Platform"), operated by RAPIDMEDICO LLP, a limited liability partnership incorporated in India, LLPIN ADC-0032, GSTIN 08ABOFR5960R1Z1, with its registered office at Ward No. 01, Sujangarh Bypass Road, Salasar, Salasar, Sujangarh, Churu- 331506, Rajasthan, India, Jaipur, Rajasthan, India ("RapidMedico", "we", "us" or "our").
1.2 By downloading the app, creating an account, placing an order or otherwise using the Platform, you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy, and the other policies referred to here (Refund, Return & Cancellation Policy, Delivery Policy, Prescription & Medical Disclaimer, Cookie Policy). This is an electronic record under the Information Technology Act, 2000 and does not need a physical signature.
1.3 If you do not agree, please do not use the Platform.
2. Definitions#
- Customer / you: a person who uses the Platform to order medicines or healthcare products, or to access related services.
- Pharmacy: an independent, licensed retail chemist registered on the Platform.
- Delivery Partner: an independent person who delivers orders through the Platform.
- Doctor: an independent registered medical practitioner who offers consultations through the Platform.
- Order: a request made by a Customer through the Platform for products or services.
- Prescription: a valid written or electronic prescription issued by a registered medical practitioner.
3. Our role#
3.1 RapidMedico is a technology platform and intermediary. We connect Customers with independent Pharmacies, Delivery Partners and Doctors. We provide the technology, matching, communication, tracking and payment-facilitation services.
3.2 We do not manufacture, stock, store, sell or dispense medicines. Medicines are sold and dispensed by the Pharmacy that accepts your order, from its own stock, under its own drug licence and under the supervision of a registered pharmacist. The sale contract for the medicines is between you and that Pharmacy.
3.3 We are not a hospital, clinic or medical practitioner and do not provide medical advice, diagnosis or treatment. Doctors available through the Platform are independent professionals responsible for their own advice and prescriptions.
3.4 Delivery Partners are independent service providers and are not employees of RapidMedico.
4. Eligibility and your account#
4.1 You must be at least 18 years old and legally able to enter into a contract under the Indian Contract Act, 1872. A person under 18 may use the Platform only through, and under the supervision of, a parent or legal guardian who accepts these Terms on their behalf.
4.2 You must register using a valid mobile number (verified by OTP) and may be asked for your name, email and delivery address. All information must be true, accurate and kept up to date.
4.3 You are responsible for all activity under your account and for keeping your login details and OTPs confidential. Do not share OTPs with anyone, including anyone claiming to be from RapidMedico. Tell us immediately at rapidmedico10@gmail.com if you suspect unauthorised use.
4.4 One person may hold one account. We may refuse registration, or suspend or remove accounts that are duplicate, fake or in breach of these Terms.
5. Service area and availability#
5.1 The Platform works only in the cities and pin codes shown in the app at the time of ordering. We may add or remove areas at any time.
5.2 Availability of any medicine, Pharmacy or Delivery Partner is not guaranteed. The Platform may be unavailable for maintenance, technical faults or reasons beyond our control.
6. How an order works#
6.1 Order placement. You select medicines or upload a Prescription and place an Order with your delivery address and location.
6.2 Pharmacy matching. We identify the nearest registered Pharmacy and send it your request. The Pharmacy may accept, partially accept or decline. If it declines or does not respond in time, we may route the request to another Pharmacy.
6.3 Confirmation. An Order is confirmed only when a Pharmacy accepts it and you receive confirmation in the app. Until then, no sale has taken place, and we may cancel without liability.
6.4 Delivery assignment. After the Pharmacy accepts, a Delivery Partner is assigned to collect and deliver the Order. You can track progress in the app.
6.5 Handover. The Delivery Partner may ask for an OTP or confirmation at delivery. Check the items before accepting and report any problem immediately (see the Refund, Return & Cancellation Policy).
6.6 Delivery time. We aim for delivery in around 25 minutes in serviceable areas. This is an estimate only and not a guarantee. Actual time depends on Pharmacy acceptance, stock, distance, traffic, weather, prescription verification and other factors.
6.7 Privacy by design. To protect everyone, the Pharmacy does not receive your phone number, email or payment details, and you may not be shown the Pharmacy's identity. Delivery Partners see only what is needed to complete delivery. Details required by law (such as the Pharmacy's licence and name on the tax invoice) are provided on the invoice.
7. Prescriptions and regulated medicines#
7.1 Medicines in Schedule H, H1, X and other restricted categories can be supplied only against a valid Prescription, as required by the Drugs and Cosmetics Act, 1940 and the Drugs Rules, 1945, the NDPS Act, 1985 and other applicable laws.
7.2 A valid Prescription must be legible, current, issued by a registered medical practitioner, and show the doctor's name and registration number, the patient's name, date, and the medicines with dose and duration.
7.3 The Pharmacy's pharmacist has the final right to verify, question, refuse or partially fulfil any Order. We may also refuse an Order that we believe is unsafe, unlawful, suspicious or fraudulent.
7.4 Submitting a forged, altered, expired or someone else's Prescription is a serious offence. We may cancel the Order, suspend your account, retain records and report the matter to the authorities.
7.5 We do not supply, and you must not try to order, medicines that are prohibited, banned or not permitted to be sold through online or delivery channels under applicable law.
7.6 Some medicines may require you to show the original Prescription at delivery.
8. Prices, fees and payment#
8.1 Medicine prices are set by the Pharmacy and will not exceed the Maximum Retail Price (MRP). Any delivery fee, platform fee, handling fee and taxes are shown before you pay.
8.2 Fees may vary by distance, time, demand and order value. Offers and coupons are subject to their own conditions and may be withdrawn at any time.
8.3 Payments are processed by third-party payment gateways through UPI, cards, net banking, wallets or cash on delivery (where available). We do not store your card number, CVV or UPI PIN. The payment gateway's terms also apply.
8.4 You authorise us and our payment partners to collect the amounts due for your Order. If a payment fails but money is debited, it is reversed by the bank or gateway as per their timelines.
8.5 Tax invoices are issued for each Order, either by the Pharmacy (for medicines) or by us (for our fees).
8.6 If a price, availability or description is displayed incorrectly, we or the Pharmacy may cancel the Order and refund any amount paid.
9. Cancellations, returns and refunds#
9.1 Cancellations, returns and refunds are governed by our Refund, Return & Cancellation Policy, which forms part of these Terms.
9.2 In summary: you can cancel for free before a Pharmacy accepts; fees may apply after acceptance; you cannot cancel once the Order is picked up. Medicines cannot generally be returned once delivered, except where the product is wrong, damaged, tampered with, expired or incomplete, and reported within the time stated in that policy.
10. Teleconsultation#
10.1 Consultations are provided by independent registered medical practitioners in line with the Telemedicine Practice Guidelines, 2020. A consultation does not create a doctor–patient relationship with RapidMedico.
10.2 Telemedicine is not suitable for emergencies or for conditions that need physical examination. In an emergency, call 112 or go to the nearest hospital.
10.3 You must give complete and accurate health information to the Doctor. The Doctor decides, in their professional judgement, whether to prescribe any medicine or to advise an in-person visit.
10.4 Consultation fees (if any) are shown before you confirm. Consultations may be recorded or logged for quality, safety and legal purposes only as disclosed in the Privacy Policy.
11. Health tools, reminders and information#
11.1 Features such as pill reminders, dose tracking, health records and AI-assisted search or suggestions are provided for convenience and general information only.
11.2 They are not a substitute for professional medical advice. Reminders may be delayed or fail because of device settings, connectivity or other factors, so do not rely on them as your only safeguard.
11.3 Product names, images and descriptions on the Platform may differ from the actual packaging. Always read the label and package insert.
12. Communications#
12.1 You agree that we may contact you by app notifications, SMS, WhatsApp, email and calls about your account, orders, safety notices and support.
12.2 Promotional messages are sent only where you have agreed, and you can opt out at any time through app settings or by replying STOP. Service and legal messages cannot be switched off while you have an active account.
13. Acceptable use#
You agree not to:
- submit false, forged, altered or another person's Prescription or identity;
- order medicines for resale, hoarding, abuse or any unlawful purpose, or try to obtain controlled substances unlawfully;
- abuse, threaten, harass or discriminate against Pharmacies, Delivery Partners, Doctors or our staff;
- attempt to contact Pharmacies or Delivery Partners to take orders off the Platform, or to find out the identity of the Pharmacy;
- misuse coupons, refunds or promotions, or create fake or duplicate accounts;
- hack, scrape, reverse-engineer, overload or interfere with the Platform, or bypass its security;
- upload malware, unlawful, defamatory, obscene or infringing content;
- use the Platform in violation of any law.
We may suspend or terminate access, cancel orders, withhold refunds linked to fraud, and report unlawful activity to authorities.
14. Ratings, reviews and feedback#
If you post a review, rating or feedback, you grant us a free, worldwide, non-exclusive licence to use it to operate and promote the Platform. Reviews must be honest and lawful. We may remove content that breaches these Terms.
15. Intellectual property#
The RapidMedico name, logo, app, website, software, designs, text and graphics belong to RAPIDMEDICO LLP or its licensors and are protected by law. You receive a limited, personal, non-transferable, revocable licence to use the Platform for its intended purpose. You may not copy, modify, distribute, sell, reverse-engineer or create derivative works from any part of it.
16. Third-party services and links#
The Platform relies on third-party services such as maps, payment gateways, cloud hosting, messaging and analytics. It may also link to third-party sites. We do not control and are not responsible for their content, availability or practices, and their own terms apply.
17. Disclaimers#
17.1 The Platform and all services are provided on an "as is" and "as available" basis, to the extent permitted by law.
17.2 We do not guarantee that the Platform will be uninterrupted, error-free or secure, or that any specific delivery time, price or stock will be met.
17.3 We do not warrant the quality, efficacy, safety or suitability of any medicine, which is the responsibility of the manufacturer and the dispensing Pharmacy. We do not give medical advice.
18. Limitation of liability#
18.1 To the maximum extent permitted by law, RapidMedico is not liable for any indirect, incidental, special or consequential loss, loss of profit or data, or for any act or omission of independent Pharmacies, Delivery Partners or Doctors.
18.2 Our total liability to you for any claim arising from an Order is limited to the amount you paid for that Order.
18.3 Nothing in these Terms excludes or limits liability that cannot be excluded by law, or any right you have under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.
19. Indemnity#
You agree to indemnify and hold harmless RapidMedico, its partners, employees and affiliates from any claim, loss, penalty or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or any false document or information you provide.
20. Suspension and termination#
20.1 You may stop using the Platform and delete your account at any time (Profile > Delete Account, or by writing to us).
20.2 We may suspend or terminate your access, with or without notice, if you breach these Terms, if we suspect fraud or misuse, or if required by law. Pending orders, refunds and legal obligations survive termination.
21. Force majeure#
We are not liable for any delay or failure caused by events beyond our reasonable control, including natural disasters, floods, strikes, riots, epidemics, government orders, network or power failures, cyber attacks and third-party outages.
22. Grievance redressal#
